Terms of Service

1) Eligibility & account rules

• You must be at least 18 years old and able to form a binding contract.
• You are responsible for safeguarding your account and all activity under it.
• Provide accurate information and keep it updated. We may suspend accounts that appear compromised or misused.

2) Acceptable use

• Do not cheat, exploit bugs, automate, scrape, reverse engineer, or interfere with the Service.
• Do not upload unlawful, infringing, harassing, or harmful content.
• Do not attempt unauthorized access or bypass security.

3) Virtual items, coins & gameplay

Any in-game coins, points, tokens, credits, or virtual items are for entertainment only, have no cash value, are not redeemable for money, and are non-transferable unless we expressly allow it. We may modify, reset, or remove virtual items at any time, including for balancing, fraud prevention, or policy enforcement.

No real-money gambling; no cash-out; no prizes of real-world value.

The Service does not offer real-money gambling. You cannot withdraw or cash out anything from the Service, and the Service does not award prizes or rewards of real-world value.

4) Intellectual property

We and our licensors own the Service, including software, content, trademarks, and designs. You receive a limited, non-exclusive, revocable license to use the Service for personal, non-commercial entertainment, subject to these Terms.

5) Termination

We may suspend or terminate access at any time for any reason, including suspected violations, risk to users, or legal compliance. You may stop using the Service at any time. Sections that by their nature should survive will survive termination.

6) Disclaimers & limitation of liability

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS, AND NON-INFRINGEMENT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAGIC FUN VILLAGE LLC WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS/REVENUE, OR DATA LOSS. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED US $100 OR THE AMOUNT YOU PAID TO US IN THE 12 MONTHS BEFORE THE CLAIM, WHICHEVER IS GREATER.

7) Dispute resolution (US)

If a dispute arises, contact us first to try to resolve it informally. If not resolved, you and we agree to binding arbitration on an individual basis, except either party may bring eligible claims in small claims court. You waive any right to a jury trial and to participate in class or representative actions, to the extent permitted by law.

8) Changes & governing law

We may update these Terms by posting a revised version on the Service. Continued use after the effective date means you accept the updated Terms. These Terms are governed by the laws of the State of Delaware, excluding conflict-of-law rules, except where prohibited by applicable law.
